These Terms of Service ("Terms") govern your access to and use of the TalkToPlanB messaging application, website and developer API (together, the "Service"), operated from Malaysia. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and access
You must be at least 13 years old to use the Service, and if you are under 18 you must have the involvement of a parent or guardian. To register, you provide a username, email address and phone number and verify your email with a one-time code. You agree to provide accurate registration information and to keep it up to date.
2. Your account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised use. We may refuse, suspend or terminate accounts at our discretion, including for breach of these Terms or the Acceptable Use Policy.
3. Your content
You retain ownership of the messages, voice messages, photos and files you create and send ("Your Content"). You grant us a limited licence to host, store, transmit and display Your Content solely to operate and provide the Service to you and your chosen recipients.
You are solely responsible for Your Content and for ensuring you have the rights to share it. You must not use the Service for any content or conduct prohibited by our Acceptable Use Policy or by law.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. We may remove content and suspend or terminate accounts that violate it.
5. Developer API
If you use our developer API or MCP server, you must keep your API keys secure, comply with any rate limits, and not use the API to send spam, unsolicited bulk messages, or otherwise abuse the Service. We may throttle, suspend or revoke API keys at any time to protect the Service and its users.
6. Service provided "as is"
The Service is provided on an "as is" and "as available" basis and is currently offered in early access. To the maximum extent permitted by law, we make no warranties of any kind, whether express or implied, including as to availability, reliability, fitness for a particular purpose, or that the Service will be uninterrupted, secure or error-free. The Service is not end-to-end encrypted. You use the Service at your own risk.
7. Limitation of liability
To the maximum extent permitted by applicable law, TalkToPlanB and its operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or business, arising out of or in connection with your use of (or inability to use) the Service. Nothing in these Terms excludes liability that cannot be excluded under Malaysian law.
8. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, including if you breach these Terms or the Acceptable Use Policy, or if required to protect the Service, other users, or to comply with the law. You may stop using the Service and request deletion of your account at any time.
9. Changes
We may modify the Service or these Terms from time to time. We will post the updated Terms here and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the courts of Malaysia in respect of any dispute arising out of or in connection with these Terms or the Service.
